1. Agreement to Terms

By accessing or using InstaSite Pro ("the Service"), operated at instasitepro.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

InstaSite Pro is a software-as-a-service (SaaS) platform that provides website templates, a drag-and-drop editor, hosting, and related tools for small businesses. Users subscribe to a plan, customize a website template, and publish their site through our platform.

3. Account Registration

Accounts are created automatically upon completing a purchase through our payment processor, Stripe. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during the registration process.

4. Subscription Plans and Billing

The Service is offered through monthly subscription plans (Starter at $29/mo, Pro at $49/mo, Premium at $99/mo) and optional add-ons. All payments are processed securely through Stripe. Subscriptions automatically renew each month unless canceled. Prices are listed in USD and are subject to change with 30 days' notice.

5. Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation, your site remains live through the end of your current billing period. After the billing period ends, your site will be taken offline. Your data is retained for 90 days after cancellation, after which it is permanently deleted.

6. Acceptable Use

You agree not to use the Service to: publish illegal, harmful, or fraudulent content; infringe on intellectual property rights; distribute malware or engage in phishing; send spam or unsolicited communications; attempt to gain unauthorized access to the Service or its infrastructure. We reserve the right to suspend or terminate accounts that violate these terms.

7. Content Ownership

You retain ownership of all content you create or upload to the Service, including text, images, and business information. By using the Service, you grant InstaSite Pro a limited license to host, display, and serve your content as necessary to provide the Service. Our templates, editor, platform code, and infrastructure remain the property of InstaSite Pro.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, InstaSite Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
